1.1 "HeyStar" (hereinafter referred to as “the Service”) is an AI-powered photo and video enhancement tool."HeyStar" operator Chongqing Cuyi Technology Co., Ltd (hereinafter referred to as "We" or "us") agrees to provide you with "HeyStar" services in accordance with the provisions of this agreement and the operating rules issued from time to time.
1.2 To use the Service, the user of the "HeyStar" service (hereinafter referred to as the "user" or "you") needs to recognize and agree to all the terms of this agreement. By using the "HeyStar" service, you confirm that you have fully read, understood, and accepted all terms of this service agreement. If you have any objections to this service agreement or any part of it, you should stop using the "HeyStar" service immediately.
1.3 In order to improve your experience, you agree that we can conduct investigations, research and analysis on your data under the premise of fully protecting the security of your data and information, so as to further optimize the "HeyStar" service.
1.4 The "HeyStar" service is not intend for minors. You should affirm that you are of legal age of majority in your jurisdiction and are capable of agreeing to and complying with the User Service Agreement. If you are not of legal age, please do not use the "HeyStar" service.
1.5 If you are a user outside of mainland China, you need also comply with the laws and regulations of your country or region when using the Service.
2.1 "User" refers to all individuals or organizations who directly or indirectly obtain and use the "HeyStar" software and related services.
2.2 "HeyStar" refers to the application with the name "HeyStar" legally owned and operated by us. We have the right to unilaterally change the application name.
3.1 When you use the "HeyStar" software and related services, you can obtain the "HeyStar" application or visit HeyStar related websites through pre-installation or downloading it from a third-party authorized by us. If you obtain the software from an unauthorized third party, we cannot guarantee that the unofficial version of the "HeyStar" software can be used normally, and your losses have nothing to do with us.
3.2 We may develop different application software versions for different terminal devices. You should obtain, download, and install the appropriate version according to the actual device conditions.
3.3 You can use the "HeyStar" software and related services or update the "HeyStar" version according to your own needs. If you no longer need to use the "HeyStar" software and related services, you can uninstall it yourself.
3.4 To improve user experience, we will provide software updates or changes from time to time (including but not limited to software modifications, upgrades, function enhancements, development of new services, software replacements, etc.). We will notify you of these updates, and you have the right to choose whether to accept them. However, if you do not accept an update, some functions of the Service may be restricted or become unusable.
3.5 You understand that you are responsible for preparing the necessary terminal equipment(such as computers or mobile phones) and for any costs incurred (such as data and internet fees) to use the Service.
3.6 We grants your personal, revocable, non-transferable, non-exclusive and non-commercial legal right to use "HeyStar" software and related services. All other rights not expressly authorized by this agreement are still reserved by us, and you must obtain our written permission when exercising these rights.
3.7 If you find any content infringing your rights in the "HeyStar" software and website, please immediately notify us via the email cqcuyi2024@gmail.com and provide preliminary evidence that you have relevant rights. If the content you posted on "HeyStar" is complained by relevant right holders for infringement, you can also submit a counter-notification and relevant proof of rights to us via the email cqcuyi2024@gmail.com. We will follow local laws for timely handling of your complaint or appeal.
4.1 You do not need to register an account with personal information to use the "HeyStar" service. We will automatically generate a guest account for you, which is associated with your device's unique identifier.
4.2 This guest account allows you to access and use the features of the Service. Please be aware that since the account is tied to your device, all data, including your edited photos and videos, may be lost if you uninstall the application or change devices. We are not responsible for any loss of data resulting from such actions.
5.1 User behavior requirements
You are responsible for your use of "HeyStar". Unless permitted by law or with our prior written permission, you must not engage in the following behaviors:
5.1.1 Use any plug-in, system or third-party tool that is not authorized or permitted by us to interfere with, destroy, modify the normal operation of the Service.
5.1.2Conduct any behavior that endangers computer network security or interfere with（disrupt） the normal operation of the Service, such as hacking, spreading viruses, or stealing network data.
5.1.3 Reverse engineer, reverse assemble, decompile or otherwise attempt to discover the source code of this software for the "HeyStar" software.
5.1.4 Violation of any laws and regulations, the obligations under this agreement, or the legal rights of others.
5.2 Information content specification
5.2.1 You are solely responsible for all content you create, post, upload or disseminate through our Services. You represent and warrant that you own or have all necessary rights, licenses, and permissions to submit your content and to grant us the license required to provide the Service.
5.2.2 Your content must comply with all applicable laws, regulations, and legal requirements of both the People's Republic of China and your country or region of residence, otherwise we will immediately take corresponding measures.You must not create, upload or disseminate any content that falls under, but is not limited to, the following categories:
(1) Endangers national security, discloses state secrets, or undermines national unity.
(2) Promotes terrorism, extremism, or hate speech.
(3) Facilitates illegal activities, or depicts illegal drugs, weapons, or explosives.
(4) Is sexually explicit, pornographic, or exploits minors.
(5) Harasses, bullies, defames, or threatens individuals.
(6) Infringes upon the intellectual property, privacy, or other rights of others.
(7) Constitutes misinformation, financial scams, or other deceptive practices.
(8) Encourages or glorifies self-harm or violence.
(9) Violates laws, regulations, public order, or good morals.
5.2.3 You expressly acknowledge and agree that you are solely responsible for any content generated through the AI-powered features of HeyStar. You must ensure use of these features and the resulting AI-generated content complies with all applicable laws and this Agreement.You are prohibited from using these features to:
(1) Create false, deceptive, or misleading information, including content for misinformation or malicious impersonation.
(2) Remove, alter, or obscure any watermarks, copyright notices, or other proprietary markings.
(3)Infringe upon the intellectual property, privacy, portrait, or other rights of any third party.
(4)Generate any content that is prohibited under Section 5.2.2 of this Agreement.
We do not guarantee the accuracy, legality, or fitness for purpose of AI-generated content.
6.1 For your violation of this agreement or other terms of the Service, we have the right to independently judge and take appropriate measures, including but not limited to issuing a warning, refusing to publish content, blocking information sharing, deleting audio, video and other content, or restricting or permanently disabling your account. We have the right to keep records of suspected violations and report them to the relevant authorities. We shall not be liable for any loss of your information caused by the aforementioned measures.
6.2You shall be solely liable for any claims brought by third parties due to your breach of this agreement or any other terms of service. If such breach causes us (including our affiliates, controlling entities, and successors) to incur any losses, fines, or penalties, you agree to fully compensate us for all such losses.
7.1 You understand and agree that the Service is provided in accordance with the currently available technology and conditions. We will do our best to ensure the continuity and safety of the Service. You understand that we cannot foresee and prevent legal, technical and other risks at any time, such as force majeure, hacker attacks, or system instability, which may lead to service interruptions or data loss.
7.2 You understand and agree that we may, at our sole discretion and based on our reasonable commercial judgment, modify, suspend, or terminate the Service (or any part thereof). We will provide you with reasonable advance notice for any material changes to or discontinuation of the Service that adversely impact you, except in cases of emergency, security concerns, or legal/regulatory requirements.
8.1 We own all intellectual property rights related to the content and technology provided in the "HeyStar" software and services, including but not limited to software, text, images, audio, video, and AI models.
8.2The intellectual property rights of any content you upload and publish through "HeyStar" belong to you or the original copyright owner.
8.3 To provide, operate, and improve the Service, including training our AI models, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, modify, copy, display, and create derivative works of your content. You may notify us via email cqcuyi2024@gmail.com to explicitly refuse or revoke the authorization.
8.4 You must not use any of our trademarks, trade names, or other brand features (e.g., "HeyStar"logo) without our prior written consent.
8.5 We retain all intellectual property rights in the "HeyStar" software, including the underlying AI technology and algorithms. While you own the new expressive content you create, we retain ownership of the Service itself. All rights not expressly granted to you in this agreement are reserved by us.
9.1 You understand and agree that the "HeyStar" software and related services may be affected or disturbed by various factors. We do not guarantee that the service will be uninterrupted, timely, secure, error-free or suitable for all your requirements.
9.2 You understand that in the process of using the Service, you may encounter force majeure and other factors (force majeure refers to an objective event that cannot be foreseen, cannot be overcome and cannot be avoided), including but not limited to government actions, natural disasters , Network reasons, hacker attacks, wars or any other similar incidents. When a force majeure situation occurs, we will try to repair it in a timely manner, but you agree that we will not be liable for losses caused by the force majeure.
9.3 We are granted the right to address illegal content in accordance with this agreement. However, this right does not constitute an obligation or commitment on our part, nor can we guarantee the timely identification of or response to unlawful activities.
9.4 You acknowledge and agree that any use of the Service shall be at your sole discretion and risk. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.5 AI-POWERED FEATURES ARE PROVIDED ON AN "AS-IS" BASIS. YOU ACKNOWLEDGE THAT AI SYSTEMS CAN PRODUCE INACCURATE, BIASED, OR UNEXPECTED OUTPUTS. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT GENERATED THROUGH HEYSTAR'S AI FEATURES. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VERIFYING ANY AI-GENERATED CONTENT BEFORE USE OR PUBLICATION.
10.1 The "HeyStar" software and services provide access to information, content links, and additional features that we or our affiliates lawfully offer. These features may be presented as distinct sections within the app. We reserve the right to update these sections by adding, removing, or changing their features and services at our discretion.
10.2 You can enable and use these additional features within "HeyStar". Please note that some features are governed by their own Additional Terms or specific rules that form a separate agreement between you and the service provider. These terms will be made clearly available to you. Your use of any such feature constitutes your agreement to be bound by its corresponding terms.
10.3 Your use of any third-party software or services within "HeyStar" is subject not only to this Agreement but also to the respective terms and conditions of that third party. Any issues resulting from your use of third-party offerings are solely between you and that third party, and we are not involved in such matters.
11.1 HeyStar’s template-based image/video creation and photo enhancement features are available to all users. However, based on our operations, some templates may not be free for non-paying users. You can purchase a membership to unlock full access.
11.2 All subscription fees are processed through the in-app purchase system of Apple or Google Play, depending on the platform of your device. You agree to comply with the applicable terms and conditions of each of the above parties.
11.4 The membership service period is based on the term you select at the time of purchase. This product currently offers weekly and annual subscription plans. When the service period expires, your membership service will be terminated. You may receive a reminder to renew your subscription 24 hours before the end of the service period.
This product provides an auto-renewal service. The renewal and billing time for auto-renewal is subject to the subscription billing schedule of the Apple App Store and Google Play platforms. If you wish to cancel auto-renewal, please go to “Settings – Subscriptions-Manage”, select your current subscription, and tap “Cancel Subscription”
11.4 In this app, access to the AI image generation, AI video, and enhancement features, as well as their results, requires spending coins in accordance with our marketing strategy. When users do not have sufficient coins, we also provide in-app purchase options to acquire additional coins. Please note that because coins are consumable virtual items, we do not support refunds for coin purchases.
12.1 This Agreement shall be governed by the laws of the Mainland of the People’s Republic of China, without regard to its conflict of law provisions. However, this shall not deprive consumers of the protection afforded to them by mandatory provisions of the laws of their country of residence. In the event of any conflict or inconsistency in the interpretation of this Agreement under different legal systems,the interpretation shall, to the maximum extent permitted by law, give effect to the original intent of this Agreement.
12.2 The place of signing of this agreement is Yubei District, Chongqing City, the People's Republic of China. If you have a dispute with us, both parties should try to resolve it through friendly negotiation. If the negotiation fails, you agree to submit the dispute to the People's Court of Yubei District, Chongqing City，China. For users residing within the EEA, the United Kingdom, Switzerland, or any jurisdiction with mandatory consumer protection laws, you may bring a claim in your country of residence in accordance with the mandatory laws of your jurisdiction.
12.3 We have the right to modify this agreement based on changes in policies, technical conditions, or product features. We will publish the revised agreement and notify you in an appropriate manner. If you continue to use the Service after the modification, you will be deemed to have accepted the revised agreement. If you do not agree, you must stop using the Service.
13.1 Any notifications from us to you under this agreement may be made via web announcements, emails, system notifications, or other means, and are deemed delivered on the date of sending.
